Terms of Service
These Terms of Service (the "Terms") explain the agreement between you and DisVideoAI ("DisVideoAI," "we," or "us") for accessing our websites, applications, APIs, and related services (collectively, the "Service").
By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.
1. Acceptance and Eligibility
- You must be at least 18 years old, or the age of legal majority in your jurisdiction (whichever is higher), to use the Service.
- By using the Service, you represent and warrant that you meet this requirement.
- We may request proof of age and may suspend or terminate accounts that do not meet eligibility requirements.
- If you are under the required age, you may not use the Service.
2. Accounts
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must provide accurate registration and billing information and keep it up to date.
- You must notify us promptly of unauthorized access or suspected account compromise.
3. Description of Services
DisVideoAI provides AI-powered tools and workflows that may include media generation, editing, enhancement, conversion, automation, and related support features. We may add, remove, or modify features at any time.
4. Subscriptions, Credits, and Billing
- Pricing, plan features, and credit allotments are described on the billing page or the order form you accepted.
- Subscriptions renew automatically at the end of each billing cycle unless you cancel through your dashboard or contact support before the renewal date.
- Usage-based credits, add-ons, or marketplace purchases are deducted as they are consumed; unused credits typically expire at the end of the stated period.
- All fees are non-refundable except as described in our Refund Policy or where required by law. Taxes, currency conversion fees, and bank charges are your responsibility.
5. Prohibited Uses
You may not use the Service to:
- Break any law or infringe the rights of others, including intellectual property, privacy, publicity, or contractual rights.
- Generate, upload, or distribute illegal, fraudulent, deceptive, or malicious content.
- Generate, upload, or distribute content that exploits minors or constitutes child sexual abuse material (CSAM).
- Generate, upload, or distribute sexually explicit, pornographic, nude, or other adult ("NSFW") content, including sexually suggestive depictions of real or fictional persons, regardless of whether all depicted parties appear to be adults or consenting. This blanket prohibition applies to every model, tool, workflow, and output available through the Service.
- Create non-consensual intimate imagery, deepfake sexual content of real persons, or other non-consensual exploitative content.
- Promote terrorism, violent extremism, serious violence, or self-harm.
- Harass, stalk, bully, threaten, or defame others.
- Distribute malware, viruses, phishing content, or other harmful code.
- Attempt to reverse engineer, probe, or breach the security of the Service, including unauthorized access attempts.
- Use automated scraping, bots, or similar methods to access the Service without our written permission.
- Attempt to bypass, disable, or defeat our prompt filters, output moderation, safety classifiers, age-gating, or any other content safety control, including by using coded language, jailbreaks, adversarial prompts, external tools, or third-party models to produce content that would otherwise be prohibited.
- Resell, sublicense, or redistribute the Service without authorization.
- Interfere with or disrupt the availability, reliability, or integrity of the Service.
Violation of this section may result in content removal, warnings, rate limits, suspension, termination, legal action, and referral to law enforcement when required.
6. Content Restrictions and Safety
All content you submit, generate, or share through the Service must comply with applicable law and these Terms.
- No illegal content.
- No CSAM or sexual exploitation of minors.
- No sexually explicit, pornographic, nude, or otherwise adult ("NSFW") content of any kind — including depictions of sexual acts, sexual arousal, genitalia, or sexualized nudity, whether involving real people, fictional characters, or AI-generated subjects, and regardless of whether depicted parties appear to be adults or consenting.
- No non-consensual sexualized or intimate depictions of real individuals.
- No hate speech or content that promotes discrimination, hostility, or violence against protected groups.
- No graphic violence or content intended to glorify extreme harm.
- No phishing, spam, or malicious content.
- No infringement of third-party intellectual property rights.
This prohibition on sexually explicit and adult content applies uniformly across every AI model, feature, and workflow offered through the Service, regardless of any permissions granted by the underlying third-party model outside our platform.
To maintain platform safety, DisVideoAI may apply a combination of automated and human moderation, including prompt filtering, output scanning, user reports, and case review. We may remove or block content, restrict features, issue warnings, suspend accounts, or permanently terminate access for repeated or severe violations.
Reporting Prohibited Content
If you believe content, an account, or a shared link on DisVideoAI breaks the rules above, report it to support@disvideo.ai with [Report] at the start of the subject line. You do not need an account to send a report.
Include as much of the following as you can:
- A link to the content or page, or the file itself.
- What is wrong with it, and which rule above it breaks.
- Whether you, or someone you represent, appear in it.
- How to reach you if we need more detail.
A person assesses every report against these Terms. Child sexual abuse material, non-consensual intimate imagery, and credible threats of harm are escalated immediately, ahead of the queue. Where a report is upheld we may remove or block the content, restrict or terminate the account responsible, preserve evidence, and report unlawful conduct to law enforcement.
If you are the person depicted in generated content and want it taken down, say so in your report; you do not need to identify which rule it breaks. Reports made in bad faith, or to harass another user, may lead to action against your own account.
7. User Content
- You own the inputs you provide and, subject to third-party rights, the outputs generated for you.
- You grant DisVideoAI a worldwide, non-exclusive license to host, process, and display your content solely to operate and improve the Service, comply with law, and enforce these Terms.
- You are responsible for obtaining any rights or permissions needed for third-party content you supply.
8. Intellectual Property
- The Service, including software, documentation, models, and branding, is owned by DisVideoAI or our licensors and is protected by intellectual property laws.
- You may not remove proprietary notices, copy, or create derivative works from the Service except as expressly allowed by these Terms.
9. Privacy and Data Use
- We collect and process account, billing, usage, and technical information as needed to provide, secure, and improve the Service.
- We may use cookies and similar technologies for functionality, analytics, and fraud prevention.
- Our Privacy Policy explains how we collect, use, and share personal data. By using the Service, you consent to those practices.
10. Third-Party Services
The Service may integrate with third-party platforms or offer links to external sites. Those services are governed by their own terms. DisVideoAI is not responsible for their actions, availability, or data handling practices.
11. Service Changes and Availability
- We continually improve the Service and may add, remove, or modify features.
- We are not liable for delays or failures caused by events beyond our reasonable control, such as internet outages, natural disasters, or regulatory actions.
- We will provide advance notice of material changes when feasible.
12. Suspension and Termination
- You may stop using the Service at any time. To end a subscription, follow the cancellation steps on the billing page.
- We may suspend or terminate your access if you breach these Terms, fail to pay fees, or create risk to other users or our infrastructure.
- Upon termination, your right to use the Service ends immediately, but sections that by their nature should survive (including payment obligations, confidentiality, and indemnities) will continue.
13. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. DisVideoAI disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that content will meet your requirements.
14. Limitation of Liability
To the maximum extent permitted by law, DisVideoAI and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, including lost profits, data loss, or business interruption. Our aggregate liability for any claim related to the Service will not exceed the amounts you paid to us for the Service in the six months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so these limits may not fully apply to you.
15. Indemnification
You agree to indemnify and hold harmless DisVideoAI, its officers, employees, and partners from any claims, damages, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.
16. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules.
- Disputes will be handled in the state or federal courts located in Delaware, and you consent to their jurisdiction.
- Before filing a claim, both parties agree to attempt to resolve the dispute informally within 30 days after written notice.
17. Updates to These Terms
We may update these Terms to reflect changes in the Service, legal requirements, or risk controls. When we do, we will post the updated Terms with a new date. Continued use after the effective date constitutes acceptance of the revised Terms.
